TERMS OF SERVICE
I can draw:
-Original characters/fan character/fanart.-Male/female/androgynous features.-Human/Humanoid/Anthro.-Complex poses and desings.-Slight NSFW or erotic situations.Ask me for (Less experience):-Monster and/or furry/feral.-Explicit NSFW.-Triggering subjets (trauma, mental illness, gore, etc.).-Animals.I won't draw:
-Complex weapons.-Hate art.-Lolicon/Shotacon.-Any sexual situation involving minors or minor-looking characters.-Any piece that incites hatred or may harm third parties.-Rape/non-consensual practices.-Very marked age gap (in a sexual situation).
General terms
-These Terms can change at any moment, without prior advise. However, if these Terms change after your request, it will be subject to the previous Terms.-I can reject your request without giving any explanation.-Items like wheelchairs, service dogs, and any item disabled people use as mobility aid won't be charged to the original price.-The client have to be especific with the details of the illustration. I will be sending WIPs of the piece while im working on it, and changes before the final product it's finished are not allowed.-I take from 5 to 20 days to make a comission (depending of the complex and the details of the illustration). I could take less if the illustration it's something express.-Selling the final product as a NFT is completely prohibited. If necessary, I will fill a DMCA form to take your post down.
Payment terms and Refund terms
-Payment will always be made via PayPal and Ko-fi, all prices are stated in USD.-Full payment will be made in advance, without exceptions.-I will not start the comission unless the payment it's done.-If your commission price it's over 150$, you can request a payment plan.-Some details will increase the price:+Extra character: +60% original price.
+Complex background: +40% original price.
+Commercial use: +100% original price.-My mistakes will be fixed without any extra charge.-You will only get a full refund if you see the first sketch and you decide to not continue with the project. Otherwise, the proccess will be too advanced and you'll get less money back.-Once the final product is delivered, there will not be any refund.-Refund %:+Sketch: 100%
+Lineart: 50%
+Coloring and rendering: 20%
+Final drawing: 0%

The rights of each piece the artist produces, belong to the artist (unless you buy the commercial rights added in the price list).This means I, the artist, am allowed to:-Show the final product in my portfolio/social media/as an example of my commissions' list (unless stated otherwise).However, as the artist, I am not allowed to:-Sell the final product in my own merch.
-Re-sell the drawing in any form.
If at any time I, the artist, were to break or disobey any of these clauses, you, the customer, are entitled to a full refund (even if the final product has already been delivered).The customer's rights
You, the customer, are allowed to use the piece for personal use in any case (it means you can't profit/create merch/earn money with the final product).If you don't own the commercial rights over the final product, as the customer, you are not allowed to:-Sell the final product in your merch.
-Re-sell the drawing in any way.
-Make monetary profit of the drawing in any way.If at any time you, the customer, were to break or disobey any of these clauses without reaching an agreement with me, I, the artist, am entitled to not work again with you in any way, add you to my public blacklist and, if needed, issue a DMCA takedown notice (Digital Millennium Copyright Act).ONCE YOU, THE CLIENT, HAVE PLACED YOUR ORDER WITH ME, THE ARTIST, THESE CLAUSES WILL AUTOMATICALLY APPLY TO BOTH PARTIES, EVEN IF YOU HAVE NOT READ THESE TERMS. Puedo dibujar:
-Personajes originales y fanart.-Rasgos masculino/femeninos/andróginos.-Humanos/Humanoides/Anthros.-Poses y diseños complejos.-NSFW sutíl y situaciones eróticas.Puedes preguntarme (Menos experiencia):-Monstruos y furries.-NSFW explícito.-Temas triggering (trauma, trastornos mentales, gore, etc.).-Animales.No voy a dibujar:
-Armas complejas.-Arte de odio.-Lolicon/Shotacon.-Alguna situación sexual que involucre a algún menor de edad o a alguien con apariencia de menor de edad.-Algo que incite al odio o afecte a terceros.-Violación/prácticas no consensuadas.-Una diferencia de edad muy marcada (en situaciones eróticas).
Términos generales
-Estos términos pueden cambiar en cualquier momento, sin aviso previo. Sin embargo, si estos términos cambian después de tu pedido, va a estar sujeto a los términos anteriores.-Puedo negar tu pedido sin dar explicación alguna.-Elementos como sillas de ruedas, perros de servicio, y algún otro elemento utilizado por personas discapacitadas para su movilidad no significará un monto extra para la pieza original.-El cliente debe ser específico con los detalles de la ilustración. Varios adelantos(WIP) de la pieza serán enviados mientras estoy trabajando en ella, y los cambios que se decidan hacer después de haber terminado el producto final no serán aceptados.-Tomo de 5 a 20 días para hacer una comisión (dependiendo de la complejidad y los detalles de la ilustración). Podría tomar menos si la ilustración es para una fecha específica (express).-Vender el resultado final como NFT es completamente prohibido. Si es necesario, voy a llenar un documento DMCA para bajar tu post.
Términos de pago y términos de reembolso
-El pago va a ser realizado vía Paypal o Ko-fi, y todos los precios están en moneda estadounidense (Dólares).-El pago completo debe ser realizado previamente, sin excepción.-No voy a empezar a realizar tu comisión a menos que el pago haya sido realizado.-Si el precio de tu comisión es mayor a los 150$, puedes pedir por un plan de pago.-Algunos detalles van a incrementar el precio:+Personaje extra: +60% al precio original.

Los derechos de cada pieza que produzca el artista, pertenecen al artista (a menos que compres los derechos comerciales agregados a la lista de precios).Esto significa que yo, el artista, tengo permitido:-Mostrar el resultado final en mi portafolio/redes sociales/como un ejemplo en mi lista de comisiones (a excepción de que se plantee otra cosa).Sin embargo, como el artista, no tengo permmitido:-Vender el producto final como mercancía.
-Re-vender el dibujo de cualquier manera.
Si en algún momento yo, el artista, rompo o desobedezco alguna de estas cláusulas, tú, el comprador, tienes el derecho a tener un reembolso completo (incluso si el producto final ya ha sido entregado).Los derechos del comprador
Tú, el comprador, tienes permitido usar la pieza/ilustración para uso personal en cualquier caso (lo cual significa que no puedes ganar dinero de ninguna manera con el producto final).Si no tienes los derechos comerciales sobre el producto final, como comprador, no tienes permitido:-Vender el producto en tu mercancía.
-Re-vender el producto de ninguna manera.
-Generar ganancia monetaria del dibujo de ninguna manera.Si tú, el comprador, rompes o desobedeces alguna de estas clausulas sin llegar a un acuerdo conmigo, el artista, tengo el derecho de no volver a trabajar contigo de ninguna manera posible, agregarte a mi lista negra pública y, si es necesario, llenar una forma DMCA (Digital Millennium Copyright Act).UNA VEZ QUE TÚ, EL CLIENTE, HAS CONCRETADO UNA ORDEN CONMIGO, EL ARTISTA, ESTAS CLAUSULAS VAN A APLICAR AUTOMÁTICAMENTE A AMBAS PARTES, AUNQUE NO HAYAS LEÍDO ESTOS TÉRMINOS.
